Sorell Consulting Pre-designed Home Plans Purchase Agreement Terms and Conditions

By purchasing and Using the Products and Services of Sorell Consulting Ltd., you agree to the following Terms and Conditions:

All products and services provided by Sorell Consulting Ltd is owned by Sorell Consulting Ltd. Sorell Consulting Ltd. is the designer of all Instruments of Service, including plans, drawings, sketches, specifications, and other information provided and continues to be, even after the sale, the owner of the work. We are providing a license to use the Instruments of Service to construct a single home. Any duplication, reuse, sale, or publication, in whole or in part, or derivative use of any plans, drawings, sketches, specifications, or any other document or Instrument of Service, beyond what is stated in your original purchase agreement, will constitute a breach of this agreement.

The plans purchased are NOT returnable. However, if for some reason you find that the plans you have purchased does not meet your needs, you may exchange that plan for any other plan in our collection at same cost. We allow you 30 days from your original invoice date to make an exchange. At the time of the exchange, we will credit you 75% of the purchase price towards another order, plus the difference in price between the plans (if applicable). If the returned home plans look used, redlined, or copied, we regrettably will not be able to honour your exchange. CAD or PDF files cannot be exchanged or returned.

If you find after your initial purchase that you require additional sets of plans, you may purchase them at special reorder prices.

The designers have put substantial care and effort into the creation of their home plans. However, since we cannot provide on-site consultation, supervision, and control over actual construction, and because of the great variance in local building requirements, building practices, and soil, seismic, weather, and other conditions, WE MAKE NO WARRANTY OF ANY KIND, EXPRESSED OR IMPLIED, WITH RESPECT TO THE CONTENT OR USE OF THE PLANS, INCLUDING BUT NOT LIMITED TO ANY WARRANTY OF MERCHANTABILITY OR OF FITNESS FOR A PARTICULAR PURPOSE. ITEMS, PRICES, TERMS, AND CONDITIONS ARE SUBJECT TO CHANGE WITHOUT NOTICE.

All pricing published on our website is in United States Dollars. We do accept payment by check, wire transfer or credit card.

Our construction documents include the drawings typically needed for construction with exception of site specific information, structural engineering, plumbing and air conditioning requirements. Each plan site is intended to meet the International Building Code and/or OECS building guidelines.

Our plans have gone under a high level of review. Additional information about each plan like 3-D elevations, material options, ceiling details, pool designs, landscape designs may be available at additional cost.

Typical plans sets include:
• Cover sheet
• General notes
• Dimensioned floor plan
• Annotated Elevations
• Roof plan/details
• Cross sections
• Footing/foundation plan
• Framing plan (if applicable)
• Roof framing plan (if applicable)
• Structural details
• Service plans (Electrical and Plumbing)

Each plan was designed to meet or exceed the requirements of International Building Code and/or local building guidelines.

We authorize the use of the home plans on the expressed condition that you consult with a local licensed architect or engineer prior to beginning construction and strictly comply with all local building codes, zoning requirements, and other applicable laws, regulations, and requirements.

Purchaser agrees to comply with all local codes and building regulations. The house plans featured on www.sorell.dm website are prepared by our designers and architects. Therefore, Sorell Consulting Ltd. authorizes the sale and uses of these plans expressly conditioned upon the purchaser’s obligation and agreement to strictly comply with all applicable codes, regulations and requirements. Note that Physical Planning requires the services and seal of an engineer and/or architect for building permits to be granted.

Purchaser agrees to check and verify all dimensions and materials before construction.

Due to local availability, Sorell Consulting Ltd. cannot and does not guarantee the availability of any materials or products suggested or specified on plans. Any discrepancies or questions must be reported to the respective designer/architect prior to the start of construction.

Purchaser agrees that the use of the plan is for the construction of one house only, and that the plan or any part of it will not be reproduced by any means without the written consent of the copyright owner.

Prices and conditions are subject to change without notice. All sales are final, no refunds, however you can exchange your plan within 30 days of the purchase date (see Terms & Conditions for details).

All construction plans ordered through Sorell Consulting Ltd. are provided “as-is” and Sorell Consulting Ltd. disclaims all other warranties, expressed or implied, including merchantability or fitness of purpose. Sorell Consulting Ltd. is not liable for incidental, special, consequential, or indirect damages of any kind, including, but not limited to, loss of anticipated profits, business opportunity, or other economic loss arising out of the use of services or any construction plans received from Sorell Consulting Ltd.

It is the customer’s responsibility to ensure the accuracy, compliance with local regulations, and fitness of purpose of any plans or construction information received from Sorell Consulting Ltd. prior to use thereof.

It is the customer’s responsibility to verify the contents of an order they place within 30 days of receiving said order. In the event that an order is missing specific items or contains the wrong plan, customer must contact Sorell Consulting Ltd. immediately.

You may not assign, convey, subcontract or delegate your right, duties or obligations hereunder.

Names of materials and manufactures shown on the plans do not represent an endorsement or recommendation by the Designer. Final selections of materials are the responsibility of the home client and/or builder, including, but not limited to proper installation of materials, nailing, gluing, caulking, insulating, flashing, roofing, weatherproofing, and many other small items and details not necessarily indicated on the Plans, and over which the Designer has no control or responsibility. The Designer shall not be held liable for any error, omissions, or deficiencies in any form by any party whatsoever.
